MATTERS ARISING FROM THE MINUTES
There were no matters arising from the minutes.
REQUEST TO WAIVE CRFC FEE
HTW MOORE, WANI ROAD, KEREPEHI (84.750.283)
In November 2001 Mr Moore applied for a Building Consent to erect a second dwelling on his property, Lot 1 DPS 65188.
In accordance with the rules in the District Plan a Community Recreation Facility Contribution (CRFC) was required to be paid along with the Building Consent processing fees, etc. Mr Moore has paid the fees (including the CRFC), he has subsequently applied for a Resource Consent, asking for the CRFC to be waived.
A detailed report was attached.
A hearing had been scheduled for 9.30 am. The hearing commenced at 9.40 am.
Mr S Haakma and Mrs C Haakma attended the meeting for the benefit of the hearing.
Mr Haakma introduced himself as the son-in-law of Mr and Mrs Moore and advised that he would be representing them at the hearing, as they could not be present due to ill health. Mr Haakma tabled a written submission outlining the reasons for the application to waive the CRFC Fee.
Mr Haakma outlined Mr and Mrs Moore’s health problems. He commented that because of the Moore’s age and the frailty of their health they were not users of community recreational facilities. Mr Haakma advised that projections showed a decline in population on the site well beyond the planning term specified by Council and felt that there was no expected increase in demand for community recreational facilities as a result of development on the site. Mr and Mrs Moore should therefore be exempted from paying the Community Recreational Facilities Contribution.
Cr Tregidga outlined the CRFC was for the long term and outlined the reasons why the fee was charged.
It was noted that Mr Moore had been an active member of the drainage and catchments boards over the years.
Planners Report
Miss van Steenbergen advised that the Resource Management Act required Council’s District Plan to be reviewed at least every 10 years. The CRFC did not relate to individuals but to a much broader scale.
Presently the Haakmas lived in a dwelling on an adjoining property to the Moore’s but once the granny flat was built they would be moving into the Moore’s residence.
It was asked if it would be acceptable to impose a condition that one of the dwellings be removed once the Haakma’s had no dependant family members living with them.
Mr Haakma replied that it would be difficult to answer this without first consulting with family.
The hearing closed at 10.15 am.
The Chairman advised that Council’s decision was reserved until it had considered the evidence presented and all other relevant matters.
The meeting adjourned at 10.17 am until 1.50 pm.
DECISION
After discussion the Committee decided:
RESOLVED
THAT pursuant to Section 105 of the Resource Management Act 1991 the Hauraki District Council grants consent in part to a non notified non complying activity to waive the requirement for the payment of a Community Recreation Facilities Contribution (CRFC) for an additional one-bedroom dwelling unit on Lot 1 DPS 65188, Wani Road, Kerepehi, for HTW Moore.
The consent is granted in part only as a CRFC shall still be paid but at a lesser sum than that provided for in Section 10.2.11.3 of the District Plan, on the grounds that the small dwelling unit is intended for use/occupation by elderly/dependant members of the family residing on the site, and the design occupancy of the unit (2 persons) is lower than that of the average household size (2.84 persons) in the Plains Ward.
Accordingly the standard CRFC for the Plains Ward is discounted 60% to $774.34 plus GST.
