CONFIRMATION OF MINUTES

MEETING HELD THURSDAY 23 OCTOBER 2003

RESOLVED

THAT the minutes of the meeting of the Hearings Committee held on Thursday, 23 October 2003 be taken as read and confirmed.

MATTERS ARISING FROM THE MINUTES

There were no matters arising from the minutes.

 

NOTICE UNDER SECTION 12(a) OF THE CONTROL OF DOGS BYLAW 11991)

APPLICATION FOR DISPENSATION TO KEEP 2 OR MORE DOGS ON PROPERTY

D. MCKINNON & G MCTAINSH - LOTS. 40,44 AND 45 OLD WAITEKAURI ROAD. WAIKINO

The applicants, D McKinnon and G McTainsh have applied for dispensation to keep more than two (2)

dogs at their property.

 

A detailed report was attached.

A hearing has been scheduled for 9.00am. The hearing commenced at 9.05am.

Ms McKinnon and Mr McTainsh attended for the benefit of the hearing.

Ms McKinnon informed the members that she was the owner of three (3) female dogs, registered in her

name. One of the dogs is spayed and the two younger dogs which are not spayed are housed in a caged

pen. Mr McTainsh is the owner of three (3) other dogs which have been visiting the property. The

Chairperson commented on the fact that there had been previous complaints regarding the behaviour of

the dogs and informed Ms McKinnon that the previous complaints made regarding the dogs had no affect

on this hearing.

Ms McKinnon was informed that under the Bylaw, if the fencing is inadequate the dispensation can be

revoked and as from the 1 December 2003 new legislation states, that if a dog leaves the property and is

in any way threatening outside the property or if the dog is unregistered, the dog control officer's have the

right to impound the dog.

Ms McKinnon commented that the boundary fencing has been erected which was deer fencing but was

still in need of completion to comply with the neighbours requests.

RESOLVED

1. Ms McKinnon to be advised in writing stating that a decision on the application to keep (3)

dogs on her property at Old Waitekauri Road, Waikino, be reserved until 18 December 2003 and to reduce the number of dogs on her property to the three (3) dogs owned by herself by that date.

2 Mr McTainsh to remove his dogs from the property by 18 December 2003.

3. Ms McKlnnon to make arrangements with Councils' dog ranger and/or the writer to visit her

property on 17 December 2003 so that a report can be given at the Council meeting on 18

December 2003.

2002/2003 DISTRICT LICENSING AUTHORITY LIQUOR LICENSING REPORT

RESOLVED

THAT the 2002/2003 District Licensing Agency Annual Report be endorsed by Hauraki District

Council, and be submitted to the Liquor Licensing Authority.

The meeting adjourned at 10.25am.

The hearing reconvened at 1.l5pm on Thursday, 18 December 2003.

The Chief Executive attended the meeting at 1.1 5pm.

The Dog Control Officer presented a report stating that he had visited Ms McKinnon's property on 17

December 2003 and spoke with Mr McTainsh. Mr McTainsh stated that he had not received the

correspondence from Mr R Bierre, Supervisor Environmental Services dated 4 December 2003

requesting the number of dogs be reduced to three by 17 December 2003.

RESOLVED

THAT approval be given to Deanna McKinnon as property owner to keep three (3) dogs only on

the property at Old Waitekauri Road, Waikino subject to the following conditions:

1. Dogs to remain securely confined and adequately kennelled on the property while not under the proper control of the owner.

2. That the keeping of three dogs now and in the future should not create nuisance conditions

nor justified complaints from neighbours.

3. Dogs to be currently registered in accordance with the Dog Control Act 1996.

4. Dispensation will be revoked if any of the above conditions are breached.
