RECOMMENDATION

THAT the minutes of the meeting of the Hearings Committee held on Thursday 22 July 2004 be taken as read and confirmed.

5. NOTICE UNDER SECTION 31(2) DOG CONTROL ACT 1996 DANGEROUS DOG)

5.1 APPLICATION FOR OBJECTION – MR K NEWLAND 8-10 (12KB)

Members will recall that at the meeting of Thursday, 22 July 2004, it was resolved that the appeal by Mr K Newland to a dangerous dog classification be held over until the next Hearing’s Committee meeting of Thursday, 19 August 2004, and that the Supervisor of Council’s Environmental Services present a report outlining the options the Committee can consider.

Attached is a report from the Supervisor, Environmental Services outlining the options to further consider the matter, including two photographs which have been provided by Mr Newland showing the enclosure for the containment of the dog on the property.

6. DISTRICT PLAN REVIEW – INITIAL STEPS (800.000.216) 11-13 (18KB)

Attached is a report from the Manager, Planning and Environmental Services regarding the District Plan Review for general discussion.

RECOMMENDATION

THAT the report be received.

7. SERVING OF LEGAL NOTICES

The Manager, Planning and Environmental Services will be addressing the Committee to discuss the protocols and practices that are to be used in relation to the serving of legal notices.

PROCEDURE FOR HEARINGS

1. Chairman

The Chairman will declare the hearing open and advise on the procedure to be followed.

 

2. Council Secretary

The Council Secretary will read the application and determine:

If the applicant is in attendance, or represented;

If there are any witnesses in support.

If there are any submissioners in attendance;

If there are any witnesses in support.

 

3. Applicant

The applicant will present the application and call any witnesses in support, and answer any questions from the Councillors.

 

4. Submissions to be Heard

The submissioners may present their submissions, calling any witnesses in support and answering any questions from the Councillors.

 

5. Planning Officer

The Planning Officer will present a report and answer any questions from the Councillors.

 

6. Right of Reply

The applicant now has the right of reply.

 

7. Close of Hearing

The Chairman will close the hearing and advise that Council’s decision is reserved until it has considered the evidence presented and all relevant matters.
