MATTERS ARISING FROM THE MINUTES
Application for Dispensation – D McKinnon and G McTainsh
The Dog Control Officer reported that he had visited Ms McKinnon at her property at Old Waitekauri Road, Waikino in January and was informed that Mr McTainsh had left the property with his dogs and has relocated to a Paeroa address. Ms McKinnon has only three dogs residing on the property now as required.

APPLICATION FOR OBJECTION TO SECTION 31(2) NOTICE DOG CONTROL ACT 1996
B. ROBINSON, 16 SHOALHAVEN STREET, PAEROA
A hearing had been scheduled for 9.00am. The hearing commenced at 9.10am.
The Dog Control Officer informed the meeting that Mr Baedyn Robinson would not be attending the hearing in support of his application.
Attached was a report from the Supervisor (Environmental Services) regarding an Application for Objection to Section 31(2) Notice Dog Control Act 1996 served on B Robinson of 16 Shoalhaven Street, Paeroa.
Mr Bierre outlined a report regarding the background of the application informing the members of a complaint received from Mrs Rhonda May of 20 Shoalhaven Street, Paeroa as a result of Mr Robinson’s male Pitt Bull Cross biting her son, Jordan on the lower leg.
The Dog Control Officer presented a further report outlining the correspondence received and documentation filed in support of the Dangerous Dog Classification. He reported on the incident regarding Jordan May of 20 Shoalhaven Street being bitten on the leg on Tuesday 25 November 2003 and that 48 hours later, a complaint was lodged with the Council by his mother, Rhonda May. The Dog Dontrol Officer and Mr Bierre met with Mr Robinson and discussed the threatening nature of the dog and the issue of a threat to public safety.
Mr Robinson was informed that his dog "Fat Boy" had been declared dangerous and accordingly, the dog would be uplifted and impounded if the dog is found roaming or if further incidences should arise.
DECISION
After considering all the evidence the Committee decided:
RESOLVED
THAT the classification be upheld.

OBJECTION BY L R TEMPLETON RE NOTICE TO CLASSIFY DOG AS MENACING UNDER SECTION 33A DOG CONTROL AMENDMENT ACT 2003 (63.100.023)
Mr Bierre informed the meeting that the hearing for the Objection to the Notice to Classify Dog as Menacing Under Section 33A Dog Control Amendment Act 2003 for Mr L Templeton of 27 Kitchener Street, Waihi scheuled for 9.30am has been re-scheduled for Thursday, 19 February at 9.00am due to Mr Templeton informing Council staff that he had not been given enough notice of the hearing.
The hearing closed at 9.20am.
