RECOMMENDATION
THAT the minutes of the meeting of the Hearings Committee held on Monday 19 September 2005 be taken as read and confirmed.

6.1 APPLICATION FOR "AL FRESCO" DINING – ROB ROY HOTEL, WAIHI (66.003.602)

Attached is a report from the Supervisor, Environmental Services regarding an application received from the owners of the Rob Roy Hotel, Waihi requesting permission to allow them to use an area of footpath in front of the Hotel for lounge bar customers.
A detailed report is attached.
A hearing has been scheduled for 9.15am.
RECOMMENDATION
THAT the report be received
AND THAT the application by Mr McKernan from the Rob Roy Hotel for Al Fresco dining in the areas delineated on the plan be granted subject to the following conditions:-
That permission be granted for a trial period over the 2005/2006 summer to Easter 2006 and that the consent then be reviewed in accordance with a revised Roads and Road Traffic Bylaw.
That the main area of seating be delineated by a permanent barrier such as ropes and a 2m public access be maintained between the tables up against the building façade and the main area of seating.
That the operation be under the strict control of the Duty Bar Manager.
The street furniture shall be to the approval of Council.
Planters and screens shall be to the approval of Council.

Attached is a report from the Planner regarding an application for approval of survey plan concerning Mangatarata Developments Ltd.
A detailed report is attached.
A hearing has been scheduled for 10.15am.
RECOMMENDATION
THAT the report be received
AND THAT the survey plan submitted be approved under section 223 of the Resource Management Act 1991.

The applicant now has the right of reply.

The Chairman will close the hearing and advise that Council’s decision is reserved until it has considered the evidence presented and all relevant matters.
