7. NON-NOTIFIED RESOURCE CONSENT APPLICATIONS 23-50
The Applicant proposes to subdivide the site at Ngatitangata Road, Waihi into five lifestyle lots.
A detailed report is attached.
A hearing has been scheduled for 10.15am.
RECOMMENDATION
THAT the report be received
AND THAT pursuant to Section 104C of the Resource Management Act 1991 the Hauraki District Council refuses consent to this non-notified discretionary activity application to subdivide Lot 2 DPS 84397, located at Ngatitangata Road, Waihi into five lifestyle lots, on the grounds that:
The proposed subdivision is contrary to the objectives and policies of the Hauraki District Plan which seek to ensure the productive potential of the higher quality rural land is not reduced by the undue fragmentation of land and associated housing development.
The circumstances of the property are not unique, such that granting consent will create a precedent effect that like applications will be treated in a similar manner. This would create an adverse cumulative effect on the open rural character and amenity of the locality and the versatility and viability of productive rural land for the needs of present and future generations.
The layout of the proposed subdivision and location of proposed building sites on the lifestyle lots is not conducive to maintaining the open rural character of the locality.
Inconclusive engineering analysis to confirm the suitability and stability of a building site on proposed Lot 2.
