The applicant proposes to subdivide the site to establish nine residential lots and a balance rural lot.
A hearing has been scheduled for 9.15am.
RECOMMENDATION
THAT the report be received
AND THAT pursuant to Section 104B of the Resource Management Act 1991 the Hauraki District Council decline consent to this notified discretionary activity application to create nine residential lots, a balance rural lot and associated road to vest on Lot 90 DP 366591 on the corner of Fern Rise and Rata Lane in Paeroa, for the following reasons:
Approval to the proposed subdivision would not promote the efficient use and development of natural and physical resources. The subdivision would result in the extension of an activity unrelated to primary production into the rural zone.
The proposed subdivision is inconsistent with the relevant objectives, policies and assessment criteria of the Rural Zone that seek to ensure that a range of compatible rural land use activities can be undertaken, which benefit from the productive potential, location and rural character of the zone. The proposal will also contribute to a gradual reduction in the rural character of the area.
There is uncertainty over the long term effects on residential development of the site as proposed from possible future settlement of the compressible soils underlying the site at depth.

OBJECTION TO CONDITIONSCLEARWATER TRUST6.1
A report regarding the Clearwater Trust’s objection to conditions of subdivision consent will be circulated prior to the meeting.
7. NZ PLANNING INSTITUTE 2008 CONFERENCE – 3 – 5 APRIL 2008
Consideration of attendance to the NZ Planning Institute Conference to be held 3- 5 April 2008 will be considered. Enclosed are copies of the conference brochure for the member’s information.
