Pursuant to Section 46A(5) of the Local Government Official Information and Meetings Act 1987, the Chairman is to call for late items to be accepted. In the event of a late item, an explanation must be given as to why the item was not on the agenda and why discussion cannot be delayed for a subsequent meeting.

RECOMMENDATION
THAT the minutes of the meeting of the Hearings Committee held on Thursday 6 March 2008 be taken as read and confirmed.

NOTIFIED RESOURCE CONSENT APPLICATIONSNOTIFIED SUBDIVISION CONSENT APPLICATION TO CREATE TWO LOTS IN THE RURAL ZONE : T STEVENS, 9 FLEET STREET, WAIHI (394400)5.1
The applicant proposes to subdivide Lot 1 DPS 88716 and create two lots (one additional) Lot 1 – 5888m2 and Lot 2 – 5055m2 (to be amalgamated with SECT 190, 191 & 192 BLK XV Ohinemuri SD).
A detailed report and supporting documents from the Consultant Planner are attached.
A hearing has been scheduled for 9.15am.
RECOMMENDATION
That pursuant to Section 221(3) of the Resource Management Act 1991 the Hauraki District Council hereby resolves to cancel the consent notice B668455.5 registered against the Certificate of Title SA 70B/224.A.
Reasons:
The consent notice is no longer relevant as Council has taken over responsibility for the maintenance of Fleet Street from Symonds Street to the entrance of proposed Lot 2.
B. That pursuant to Section 104A of the Resource Management Act 1991 the Hauraki District Council grant consent to this discretionary activity application to subdivide SECT 190, 191 & 192 BLK XV Ohinemuri SD and Lot 1 DPS 88716, located at 9 Fleet Street, Waihi, into two rural lots, on the grounds that:
The proposed subdivision has no additional adverse effects on the environment that are more than minor; and
An appropriate access way and entranceway can be formed to proposed Lot 1 on the unformed portion of Fleet Street and any adverse stormwater effects can be suitably mitigated; and
The existing stormwater issues within Fleet Street are a separate matter and the proposed subdivision will not result in additional stormwater effects; and
The proposal is consistent with Council’s policy to provide for small lot lifestyle subdivision on less productive rural land; and
The proposal is consistent with the rural character and amenity value of the adjoining area; and
The proposed subdivision will not compromise the objectives and policies of the District Plan.
Subject to the following conditions:
The subdivision shall be carried out generally in accordance with the Waihi Beach Surveyors Scheme Plan ref. 1933, dated 27 September 2007.
That a Community Recreation Facilities Contribution of $1,842.94 plus GST be paid to Council for the creation of one additional lot (Waihi Ward).
That Lot 2 hereon be transferred to the owner of SECT 190, 191 & 192 BLK XV Ohinemuri SD and that one Computer Freehold Register be issued to include all parcels (Reference to be arranged).
That Fleet Street shall be extended by the subdivider to provide a suitable access point onto Lot 1. The extension to the street shall be in accordance with the Right of Way standard that is for 1-2 lots in the Rural Zone as specified in Rule 9.3.19.3 of the District Plan. The following design measures shall be included in the construction of the Right of Way:
A 4.0m wide unsealed carriageway shall be constructed.
The Right of Way construction shall intercept and dispose of all surface runoff effectively into the existing swale drains located within the road reserve boundaries of Fleet Street.
The proposed Right of Way shall match evenly into the existing access tracks to the dwelling within Sect 191 BLK XV Ohinemuri SD.
That a consent notice pursuant to Section 221 of the Resource Management Act 1991 be registered against the title of Lot 1 advising the owners that the access over the Right of Way carriageway serving Lot 1 from the entrance to Lot 2 be maintained in perpetuity by the owners of Lot 1 hereon.
That power and phone services shall be extended to the boundary of Lot 1 or that written confirmation is provided from the relevant supply authority stating that power and phone services are available at the lot boundary of Lot 1 at the standard connection fee.
That Engineering plans and specifications covering all engineering works shall be submitted to the Manager of Planning and Environmental Services for consideration and approval prior to the commencement of any work.
That 3 copies of "as-built" plans be submitted to Council upon completion of construction, showing the details required by NZS 4404:2004 Schedule 1D.
That pursuant to Section 36(1)(b) of the Resource Management Act 1991, the Applicant shall pay Council charges for receiving, processing and granting the Resource Consent.
That pursuant to Section 36(1)(c) of the Resource Management Act 1991 the applicant shall pay an administration fee of $95.00 for administration of the consent.
That pursuant to Section 36(1)(c) of the Resource Management Act 1991 the applicant shall pay all Council’s costs for monitoring this consent including all costs associated with the consideration and certification of plans and details associated with the consent as appropriate.
Advice Notes:
As-built drawings of all existing and new works required by condition 5 are to be presented on a single plan. Attention is drawn to the requirement for co-ordination of all utility surface features. All co-ordinates are to be presented in New Zealand Transverse Mercator Projection
The subdivider must ensure that appropriate silt retention devices are installed to adequately protect Council utilities, as approved by the District Engineer, HDC. The silt retention devices shall be installed prior to any earthwork operation, maintained regularly throughout the duration of the earthworks and dismantled/ removed once all bare ground surfaces have been stabilised by vegetation.
That all existing grass berms be reinstated (contoured, topsoiled and grassed) to the satisfaction of the District Engineer.
The construction of the vehicle entrances will require a vehicle crossing permit. Please contact Janet Tee at the Paeroa office on ph 07 862 8609 to proceed with the application of the permit before commencement of any work on the entrances.
Any work undertaken in the road reserve will require a street opening permit and traffic management plan to be submitted for approval before work commences. Any enquiries regarding this procedure may be directed to Janet Tee at the Paeroa offices, Tel 07-862 8609.
Please note that your street address may change as a result of the subdivision of your property. You will be advised at a later date if this is to be the case. Hauraki District Council follows the Standard New Zealand regulation governing the numbering of all rural and urban properties. This is to ensure the effective and efficient delivery of services and amongst them, emergency services such as fire, ambulance and police etc. Should you have any further queries regarding this matter, please contact the Hauraki District Council.
It is advised that the following on-site fire fighting measures be taken into consideration at the time of construction of any dwelling on Lot 1:
That sufficient water volume and pressure for fire fighting purposes shall be provided in accordance with NZFS Fire Fighting Water Suppliers Code of Practice (SNZ PAS 4509:2003).
Water supply tank shall be located a safe distance from any dwelling in accordance with NZFS Fire Fighting Water Suppliers Code of Practice (SNZ PAS 4509:2003).
That new dwellings shall be sprinklered in accordance with Fire Sprinkler Systems for Houses (NZS 4517:2002).
