As part of the Draft Annual Plan 2008/09 Special Consultative Procedure, the library book lending and associated fees were consulted on with a separate Statement of Proposal as required under the Local Government Act, 2002.

The Statement of Proposal for adoption in its final form was presented by the Strategic Planning Projects Manager for Councils consideration.

THAT pursuant to Sections 83 and 150 of the Local Government Act, 2002 the Library Book Lending and Associated Fees effective from 1 July, 2008 be adopted.

PLANNING FEES AND CHARGES 2008 (38KB)

Fees and charges under the Resource Management Act, 1991 and the Local Government Official Information and Meetings Act 1987 were reviewed in March 2008 and will become operative on 1 July 2008.

The Statement of Proposal for adoption of these fees and charges was presented in its final form for Councils consideration. The members were advised that all known stakeholders have been advised of the new fees.

RESOLVED

THAT pursuant to Section 83 of the Local Government Act, 2002 and Section 36 of the Resource Management Act, 1991, the Planning Fees and Charges 2008, effective from 1 July, 2008, be adopted.

DEVELOPMENT CONTRIBUTIONS POLICY

The completed Statement of Proposal of the Development Contributions Policy recently reviewed by Council was presented for adoption in its final form by the Strategic Planning Projects Manager.

Changes recommended to the document attached to the Agenda were:-

Replace grant, granting and granted with issue, issuing and issued respectively.

Table 1 - Move Kaimanawa and Ohinemuri to the rural section.

Insert definition of Utility Building – is a structure containing facilities (such as toilet, shower, laundry tub, hot water cylinder) that make a site habitable prior to or during the construction of a dwelling.

Add "but not limited to" in the definition of impervious surfaces.

The members were advised that following final adoption of the policy, amendments will be required to the 2006-16 LTCCP resulting from these changes.

Training for staff has been organised and a meeting is to be held briefing stakeholders on the new development contributions policy and how it will be implemented.

RESOLVED

THAT pursuant to Sections 83 and 93 of the Local Government Act, 2002 the Development Contributions Policy, effective from 1 July, 2008, as amended be adopted and the 2006 – 16 Long Term Council Community Plan be amended accordingly.

ADOPTION OF 2008/9 ANNUAL PLAN

The Strategic Planning Projects Manager advised the members that following the adoption of the Draft Plan and associated documents in March, amendments have been made incorporating Councils decisions. These amendments were noted by tracked changes in the copy of the plan for the member’s consideration.

The majority of the changes related to grammar, syntax, tense, formatting and the changes necessary to alter the draft document into a final document ready for adoption.

A number of amendments to the Draft Annual Plan were made as a result of the submissions and these were marked in the draft document. The significant amendments were summarised in the attached report.

RESOLVED

THAT pursuant to Section 95(3) of the Local Government Act 2002 the Annual Plan 2008/9, as amended, be adopted and advertised accordingly.

RATES RESOLUTION

The members were requested to consider the recommendation to approve the setting of rates for the 2008/09 rating year.

RESOLVED

THAT Council pass the following resolution necessary to set its rates for the 2008/9 rating year:

"That the following rates be set under the Local Government (Rating) Act 2002, on rating units in the district, for the year 1 July 2008 to 30 June 2009. All values are stated GST inclusive."

Uniform Annual General Charge

A uniform annual general charge (as per section 15) of $255.00 on each rating unit within the District.

Differential General Rate

A capital value general rate (as per section 13) set on a differential basis based on land use.

The categories being:

  • Residential and Rural Land Use - all rating units used primarily for residential, recreational, cultural or primarily or predominately for the purposes of agriculture, viticulture, horticulture or silviculture.
  • Commercial, Industrial and Utility Land Use - all rating units used for commercial or industrial purposes, including utility networks.
  • Mineral Extraction Land Use - all mineral value rating units that are not used in gold mining.
  • Mining Land Use - all mineral value rating units that are used in gold mining.
  • The rates in cents per dollar of Capital Value being:

    Paeroa Urban Stormwater Targeted Rate

    A land value targeted rate (per section 16) on all rating units situated within the Paeroa urban stormwater area set on a differential basis based on land use and land area.

    The categories being:

  • Rural, Recreation and Cultural Land Use Over 10 Hectares - all rating units situated in the Paeroa urban stormwater area which have a land use predominantly rural, recreational, or cultural, and which have a land area greater than 10 hectares.
  • Rural Land Use 10 Hectares and Under - all rating units situated in the Paeroa urban stormwater area which have a land use predominantly rural and which have a land area less than or equal to 10 hectares.
  • Other Land – all rating units situated in the Paeroa urban stormwater area not included in the categories Rural, Recreation and Cultural Land Use Over 10 Hectares, and Rural Land Use 10 Hectares and Under.
  • The rates in cents per dollar of land value being:

  • Rural, Recreation and Cultural Land Use Over 10 Hectares 0.03128
  • Rural Land Use 10 Hectares and Under 0.07822

  • Water Supply Annual Charge Targeted Rate

    An annual charge (per section 16) of $60.00 per metered connection will be charged on all rating units with a connection to a Council water supply.

    Water Supply Volume Targeted Rate

    A rate per unit of water supplied (per section 19) on all rating units unit on a differential basis within the following categories based on location and extent of provision of service.

    The categories being:

  • Fully Treated – rating units connected to the Paeroa, Plains and Waihi water supplies.
  • Partially Treated – rating units connected to the Kaimanawa, Karangahake, Ohinemuri, and Waikino water supplies.
  • Raw Water – rating units connected to a Council raw water main that receive completely untreated water
  • The rates in cents per cubic metre of water supplied being:

  • Fully Treated 88c
  • Partially Treated 78c
  • Raw Water 35c
  • Karangahake Water Supply Loan Targeted Rate

    An annual charge (per section 16) of $84.00 on each rating unit in the Karangahake Special Rating Area with a connection to a Council water supply.

    All rating units in this category that have elected to make a lump sum contribution benefit from the lump sum savings provisions (section 145) and do not have to pay the rate.

    Wastewater Unconnected Targeted Rate

    An annual charge (per section 16) of $252.50 on each rating unit not connected to Council schemes with a boundary within 30 metres of a wastewater main belonging to a Council wastewater scheme.

    Wastewater Connected Targeted Rate

    An annual charge (per section 16) per toilet pan or urinal according to a scale of charges based on the number of pans on the rating unit.

    The annual charges per pan or urinal being:

    • Up to & including 2 Pans $505.00
    • Up to & including 4 Pans $379.00
    • Up to & including 6 Pans $337.00
    • Up to & including 8 Pans $315.00
    • Up to & including 10 Pans $303.00
    • Up to & including 15 Pans $243.00
    • Up to & including 20 Pans $214.00
    • Over 20 pans $184.00

    Rating units used primarily as a residence for one household will be treated as having one pan (per Note 4 to Schedule 3 of the Act).

    Kerbside Refuse Collection and Recycling Targeted Rate

    An annual charge (per section 16) per separately used or inhabited part of a rating unit on a differential basis based location and the provision of service.

    The categories being:

  • District Collected – all rating units serviced by Council’s refuse collection excluding those in the Whiritoa township.
  • Whiritoa Collected – all rating units serviced by Council’s refuse collection in the Whiritoa township.
  • The annual charges being:

  • District Collected $37.00
  • Whiritoa Collected $61.00
  • Positive Paeroa Targeted Rate

    An annual charge (as per section 16) on each commercial/industrial separately used or inhabited part of a commercial/industrial rating unit in the Paeroa Ward set on a differential basis based on location.

    The categories being:

  • Paeroa Ward Urban – all rating units used principally for commercial and industrial purposes situated within the valuation rolls 5001, 5002, 5003 and 5004.
  • Paeroa Ward Rural – all rating units used principally for commercial and industrial purposes situated within the Paeroa Ward but outside the valuation rolls 5001, 5002, 5003 and 5004.
  • The annual charges being:

  • Paeroa Ward Urban $145.00
  • Paeroa Ward Rural $72.50
  • Go Waihi Targeted Rate

    An annual charge (as per section 16) on each commercial/industrial separately used or inhabited part of a commercial/industrial rating unit in the Waihi Ward set on a differential basis based on location and land use.

    The categories being:

  • Waihi Ward Urban – all rating units used principally for commercial and industrial purposes situated within the valuation rolls 5020 and 5030.
  • Waihi Ward Rural – all rating units used principally for commercial and industrial purposes situated within the Waihi Ward but outside the valuation rolls 5020 and 5030.
  • The annual charges being:

  • Waihi Ward Urban $340.00
  • Waihi Ward Rural $170.00
  • PENALTIES FOR LATE PAYMENTS AND DUE DATE OF PAYMENTS PAYMENT DATES AND METHODS

    That the above rates are payable at the Council Offices at William Street, Paeroa, Orchard Rd, Ngatea and Seddon St, Waihi between 8.00am and 4.30pm Monday to Friday. That payments may also be made by way of Direct Debits and Automatic Payments, and that Direct Credits in the form of telephone and internet banking services are also accepted.

    That excluding water supply targeted rates, the above rates are by way of three installments, the dates of such installments being:

    Water supply targeted rates are by way of two installments per year with instalment dates for the various water supply areas being staggered throughout the year. The instalment date for water rates is the invoice date.

    PENALTIES FOR LATE PAYMENT

    That Council delegates authority to the Revenue Team Leader and rating staff to apply the following penalties to outstanding rates (excluding water supply rates) at their discretion:

  • An additional charge on unpaid rates of 10% of the instalment amount will be added on the day following the last date on which the instalment is payable without incurring additional charges (as described above).

  • An additional charge of 10% will be added to all rates assessed in a previous year which remain unpaid on 1 September 2008.

  • A further additional charge of 10% will be added to all rates assessed in a previous year which remain unpaid on 1 March 2009.

  • The following penalties will be applied to water supply rates:

  • An additional charge of 5% will be added to all current and previous years’ rates outstanding on the day following the last date for payment of the first instalment.
  • An additional charge of 5% will be added to all current and previous years’ rates outstanding on the day following the last date for payment of the second instalment."

    BORROWING

    As part of last year’s Annual Plan adoption Council authorised staff to borrow up to $10 million.

    The balance of term debt at 30 June 2009 forecast in the 2008/09 Annual Plan is $8.8 million.

    Because of the timing of Council’s rates instalments and capital works the balance at 30 June does not generally reflect the highest level of borrowings required during the year. The fluctuation between the highest level of borrowing and the 30 June balance is likely to be up to $2 million.

    Assuming the capital works and operations outlined in the 2008/09 Annual Plan are carried out and the opening balances are correct Council will need to borrow approximately $11 million.

    Council’s Liability Management Policy sets the principles, rules and limits to be followed when borrowing. The $11 million proposed is well within those limits.

    RESOLVED

    THAT Council resolve to authorise borrowing funds as allowed under the Liability Management Policy in the LTCCP up to a maximum outstanding balance of $11 million at any time during the 2008/9 financial year for the purposes of funding the capital projects and operations outlined in the 2008/9 Annual Plan.

    ROADING MANAGERS REPORT (411370) (36KB)

    The Roading Manager reported on roading matters for the month of May 2008. The report was attached for the members’ information.

    08/358 Challis/Francis CARRIED

    Litter - Waihi Beach Road, Waihi

    Cr Hayden raised a concern brought to his attention by a number of Waihi Beach Road land owners concerned with the increasing and unsightly amounts of rubbish being deposited on the road verge along Waihi Beach Road. The landowners have advised that the litter is making its way onto their properties creating a health risk for their stock if it is consumed by them. They request that Council address this issue as soon as possible.

    The Roading Manager advised he will follow up on the matter.

    Power Outages in District - Street Lights

    The Chief Executive commented to the Roading Manager on a number of recent power outages which have prevented street lighting from working. The Roading Manager advised he was unsure as to why these outages were occurring but will investigate the matter with the power company.

    SAFETY MANAGEMENT

    2007/08 Minor Safety Improvement Projects

    The Roading Manager advised of safety improvements proposed for Baber Street South. This is due to the effect the dogleg in Baber Street at the Consols Street intersection creates. He recommended that a ‘Give Way’ control be installed to address issues of road safety at the location.

    RESOLVED

    THAT a ‘Give Way’ control for Baber Street South be installed to compliment the existing Baber Street North control.

    UTILITIES MANAGER’S REPORT (411656) (107KB)

    The District Engineer introduced the members to the newly appointed Utilities Manager, Mike Charteris who has replaced Dean Burwell. A report on district utilities for the month of May 2008 was presented for the member’s information.

    The Mayor proposed that a workshop be held following a Council meeting on Water Supply. The District Engineer advised of his agreement that a workshop be held for this purpose.

    Karangahake Reserve Public Toilets

    The Utilities Manager advised that to consider what is the most appropriate way of addressing the issues of wastewater concerning the reserve public toilets, Council are waiting on additional information from DOC on how wastewater is dealt with at other high use conservation areas similar to the Karangahake Reserve to allow a number of options to be considered to an upgrade of the present wastewater system. Council will also talk to property owners on the opposite side of the river to determine whether the possibility exists to trickle irrigate into the native bush blocks which are privately owned.

    PRESENTATION: ASPIRING LEADERS CONFERENCE - LAYTON FRASER

    Layton Fraser of Hauraki Plains College who attended the Aspiring Leaders Conference in Wellington and was supported by Council under the Economic Development budget was in attendance and provided a presentation to Council on what he gained from the conference.
