NOTICE IS HEREBY GIVEN THAT A MEETING OF THE HAURAKI DISTRICT COUNCIL WILL BE HELD IN THE COUNCIL CHAMBERS, WILLIAM STREET, PAEROA ON WEDNESDAY 15 APRIL 2009 COMMENCING AT 9.00 AM

Attached is a report from the District Engineer regarding the tender evaluation and recommendation for the 2008 / 2009 Area-wide Treatments.

RECOMMENDATION

THAT the report be received

AND THAT award of Contract HDC 363 Area Wide Treatment 2008/09, to Online Contractors Ltd for the amount of $234,410 by the District Engineer under delegated authority be confirmed.

The Utilities Manager has reported on district utilities to the 25th of March 2009. The report is attached for the members’ information.

Land Drainage and Stormwater Operational Maintenance Costs Separation

RECOMMENDATION

THAT the shared operational maintenance costs in Ngatea be apportioned on the following basis:

    • The maintenance of the main floodgate and pump feeder drains be the responsibility of the rural land drainage activity,

    • The operational costs of the floodgates and pumps be the responsibility of the urban stormwater activity

THAT the shared operational maintenance costs in Turua be apportioned on the following basis:

  1. The maintenance of the main floodgate feeder drains be the responsibility of the rural land drainage activity

  2. The operational costs of the floodgates be the responsibility of the urban stormwater activity

Reporting of Land Drainage and Stormwater Operations

RECOMMENDATION

THAT Council resolve its preference for either Option 1, or Option 2, for the reporting of land drainage and stormwater activities.

5.5 EASTERN PLAINS DISTRICT DRAINAGE COMMITTEE – Tuesday 24 February 2009 (467083) 39-41

RECOMMENDATION

THAT the minutes of the Eastern Plains Drainage District Committee meeting held on Tuesday 24 February 2009 be received and the recommendations contained therein adopted.

6.7 REQUEST FOR PERMISSION TO TAKE A VEHICLE ONTO WHIRITOA BEACH – DEAN LORIMER 3A MORAY PLACE WHIRITOA (CR CARMINE) (474459) (39KB)  95-96

Attached is a report from the Manager, Regulatory Services regarding a request from a Whiritoa resident seeking permission to take their quad bike onto Whiritoa Beach and foreshore for the purpose of fishing.

RECOMMENDATION

THAT the report be received

AND THAT Council grant permission to Mr Dean Lorimer to take his 4x4 bike onto Whiritoa beach and foreshore for the purpose of launching his kontiki long line, subject to the following conditions:-

  1. That a designated vehicle access point on to the beach be used at all times.

  2. That the 4x4 bike be driven at walking pace but certainly not at a greater speed than ten (10) km/h.

  3. That the 4x4 bike must not be driven so as to endanger the safety of or be an annoyance or inconvenience to persons on the beach or foreshore.

  4. The 4x4 bike shall be under the direction and orders of the appointed beach warden under the Bylaw, at all times.

  5. That the bike not be taken onto the beach during peak holiday times.

7. COMMUNITY SERVICES

7.1 PROPOSED DRILLING AT A BANKS STREET RESERVE (CR BUBB) (476116) (71KB)  97-103

Attached is a report from the Assets Operations Manager, Community Services regarding a request from Newmont Waihi Gold seeking permission to allow exploratory work to be undertaken in the Banks Street Reserve, Waihi.

RECOMMENDATION

THAT the report be received

AND THAT permission is granted to proceed with the exploration subject to adherence to the conditions offered particularly towards consent, safety and also subject to there being no disruption to the public access and enjoyment of the reserve.

8. GENERAL BUSINESS

8.1 WAIKATO REGIONAL POLICY STATEMENT – INTRODUCTION AND DISCUSSION DOCUMENT (CRS GORDON & CARMINE) (475526)104-120

The Waikato Regional Policy Statement (RPS) is currently under review, with the intention of notifying the second generation RPS in August 2010.  The RPS review team has prepared a discussion document that identifies issues and potential approaches to be considered in the RPS review. The RPS will set the future direction for managing our region's natural and physical resources with decisions made now having an impact for many decades into the future.  

Blair Dickie will be making a brief presentation on the discussion document and identifying opportunities for ongoing involvement in the project. (The RPS discussion document is available on the RPS website).

RECOMMENDATION

THAT the report be received

AND THAT his Worship the Mayor and a Councillor be appointed as Councils representatives on the proposed Joint Working Party

AND THAT the Joint Working Party be authorised to prepare and finalise the submission on behalf of its constituent authorities.

8.2 ROYAL COMMISSION ON AUCKLAND GOVERNANCE (476022) 121-176

Attached for the members information is a copy of the Executive Summary of the report by the Royal Commission on Auckland Governance.

Royal Commission has proposed in its report the following model for governance in Auckland:

"The Commission proposes the dissolution of the Auckland Regional Council and all seven territorial authorities existing in Auckland, and the creation of a new single unitary authority called the Auckland Council".

The proposed model for the governance of Auckland does not directly impact on the Hauraki District Council. The proposed southern boundaries of the Auckland region are modified and include areas on the Firth of Thames that are currently in the Franklin District becoming part of the Waikato District. These areas include the community of Kaiaua.

The member’s views on the proposed Governance Model for Auckland will be sought at the meeting. Cabinet is considering the report at its meeting on the 6 April 2009 and is likely to release a decision soon after. The matter is likely to be referred to a select committee and this would provide the Hauraki District Council with an opportunity to make a submission on the proposed model should it wish to do so.

8.3 ENERGY SUPPLY TENDER REPORT (CR GORDON) (476007) (22KB) 177

Attached is a report from the District Engineer regarding the energy supply contract tender.

RECOMMENDATION

THAT the report be received

AND THAT the tender of Genesis Power Limited be accepted

AND THAT the Chief Executive be authorised to sign the energy supply agreement on Council’s behalf.

8.4 WAIHI ABANDONED UNDERGROUND MINES GROUND SETTLEMENT MONITORING (472863) (34KB) 178-179

Attached is a report from the Chief Executive regarding the monitoring of the Waihi abandoned underground mines ground settlement. The monitoring is required to determine if significant movements are occurring, and if they are occurring, what area is affected and what the rates of settlement are. This monitoring data will be used to determine the long terms affects on the areas immediately adjacent to the pit.

Council’s approval is sought for the monitoring network to be established and for the monitoring to commence.

RECOMMENDATION

THAT the report be received

AND THAT a monitoring network be established in Waihi for an estimated cost of $25,000 and that the network be surveyed on a 3 monthly interval for 12 months and 6 monthly there after at an estimated cost of $15,000 per monitoring run.

LATE ITEMS

WORKSHOP ON MOTOR VEHICLE MILEAGE ALLOWANCE FOR ELECTED MEMBERS 180-186

Further to the report to the Council meeting on the 25 February 2009 it is proposed that a workshop be held immediately after the meeting for the purposes of discussing the proposal by the Remuneration Authority to abolish the current method of paying elected members the Mileage Allowance following the 2011 triennial elections. 

Attached for the member’s information is a copy of a memorandum from Local Government New Zealand seeking feedback by the 1 May 2009 on the proposal.  This information is provided as background with further information to be provided at the workshop.
