| Withdrawal of Proposed Plan Change 35 and
Variation 11 to Plan Change 14 to the Operative Franklin District Plan
(Clause 8D of Schedule 1, Resource Management Act 1991)
Hauraki District Council, as successor Council to Franklin District
Council, hereby gives notice that on 27 April 2011 it resolved to
withdraw Proposed Plan Change 35, and on 25 May 2011 it resolved to
withdraw Variation 11 to Plan Change 14 to the Operative Franklin
District Plan, on the grounds of procedural deficiencies in the
preparation of the Proposed Plan Change and Variation to the Plan
Change.

The above Plan Change and Variation were publicly
notified by the Franklin District Council on 28 September 2010. Proposed
Plan Change 35 involved amendments to the zoning of specific properties
located in the Hauraki District (as from 1 November 2010) in the Kaiaua
area. Some of the identified properties are subject to Rural Plan Change
14, therefore it was also necessary to effect Variation 11 to Plan
Change 14.
One of the properties involved is privately owned, and was proposed to
be rezoned to Village zone. Two of the properties are owned by Hauraki
District Council and three by Department of Conservation; these were
proposed to be rezoned from Coastal to Recreation.
Submissions closed on 10 November 2010, and 15 submissions were
received. Hauraki District Council considered the submissions, and upon
reviewing the process found that there were procedural deficiencies in
the preparation of the Proposed Plan Change, particularly with
regard to consultation. On these grounds Council resolved to withdraw
the Plan Change and Variation.
