Proposed Plan Change 4 - Miscellaneous Plan Change

Proposed Plan Change 4 proposes a number of administrative changes to the Operative Hauraki District Plan.

The proposed changes are to amend definitions; correct cross references; update maps, schedules (eg Significant Natural Areas, Heritage Features, Significant Trees) and references to external documents; and to make relatively minor amendments to improve overall consistency and administration of the District Plan.

Submissions on Proposed Plan Change 4 closed at 4pm on 16 October 2020 and further submissions closed at 4pm, 16 November 2020 and further submissions on 16 November 2020.

Council resolved that items are to be treated as Operative (no submissions, or only submissions in support received). Following on from the Council resolution, the affected maps are in the process of being updated and we expect to have them completed in the first quarter of 2021.

Changes to the District Plan

Decisions Released 18 June 2021

At its meeting on 26 May 2021, the Hauraki District Council approved the decisions on submissions and further submissions on Proposed Plan Change 4 that were recommended by the District Plan Committee. The Committee (Proposed Plan Change 4) was appointed by the Council, and delegated authority pursuant to section 34(1) of the Resource Management Act 1991, to hear, consider and recommend decisions on submissions and further submissions.

The recommended decisions were made by the District Plan Committee following the closing of the hearing held on 18 and 22 April 2021. The Committee considered all submissions and further submissions, and heard evidence at the hearing.

Appeals

Any submitter or further submitter to Plan Change 4: Miscellaneous is able to appeal the decision made by Council to the Environment Court.

If a submitter or further submitter wished to appeal all or any part of the decision they are advised to seek legal advice. Submissions that were deemed ‘out of scope’ have no Environment Court appeal rights. In addition, no appeal rights exist in relation to the withdrawn Items (6a and 93).

An appeal must be lodged with the Registrar of the Environment Court, PO Box 7147, Wellesley Street, Auckland within 30 working days of service of the notice of decision by Council. Assuming service of the notice of decision by Council on Friday 18 June 2021, if you wish to appeal the Council’s decision on your submission then it should be lodged with the Environment Court on or by 30 July 2021.

A copy of your appeal must be served on every person who made a submission on the provision or matter to which the appeal relates.
