Proposed Plan Change 4 - Miscellaneous Plan Change

Proposed Plan Change 4 proposed a number of administrative changes to the Operative Hauraki District Plan.

The proposed changes are to amend definitions; correct cross references; update maps, schedules (eg Significant Natural Areas, Heritage Features, Significant Trees) and references to external documents; and to make relatively minor amendments to improve overall consistency and administration of the District Plan.

Submissions on Proposed Plan Change 4 closed at 4pm on 16 October 2020 and further submissions closed at 4pm, 16 November 2020.

Those Items on which no submissions were received were declared operative from 16 November 2020. The District Plan text and maps have been updated to incorporate these amendments.

Hearings were held on 18 and 22 March 2021 to hear from submitters, and to consider the other Items on which submissions and further submissions were received.

The District Plan text and maps have been updated to incorporate these amendments.

Items Withdrawn:

Items 6a and 93 were withdrawn by the Council following the hearing. No amendments have therefore been made to the hazardous substances provisions of the District Plan.

RESOLVED
THAT the Hauraki District Council approves Items: 2, 4-6, 9-19, 20a-20b, 22-24, 26-30, 34-38, 39a-42, 44-50, 51a-60, 61a-61c, 63, 65, 67, 69-72, 74-79, 81-92, 98, 100-106, 108-117 of Proposed Plan Change 4: Miscellaneous Plan Change in accordance with clause 17 (1) and
(3) in Schedule 1 to the Resource Management Act 1991, and affixes the seal to Council to the plan change document incorporating those items, and

THAT the Hauraki District Council, in accordance with clause 20 (1) and (2) in Schedule 1 to the Resource Management Act 1991, publicly notifies that Items: 2, 4-6, 9-19, 20a-20b, 22-24, 26-30, 34-38, 39a-42, 44-50, 51a-60, 61a-61c, 63, 65, 67, 69-72, 74-79, 81-92, 98, 100-106, 108-117 of Plan Change 4: Miscellaneous Plan Change will become ‘Operative’ from 16 November 2020.

THAT pursuant to clause 8D of Schedule 1 to the Resource Management Act 1991, the Council resolves to withdraw Item 6a and Item 93 from ‘Proposed Plan Change 4 – Miscellaneous’ and notes the reason for its decision is that the resource management issues associated with amending the hazardous substances provisions of the District Plan are complex, inter-related and highly contested

THAT the Hauraki District Council approves Items: 1, 3, 7, 8, 20, 25, 31, 32, 33, 39, 51, 61,
62, 64, 68, 73, 80, 94, 95, 96, 97, 99 and 107 of Proposed Plan Change 4: Miscellaneous Plan Change, as amended following the consideration of submissions, in accordance with Clause 17 (1) and (3) in Schedule 1 to the Resource Management Act 1991, and affixes the seal of Council to the plan change document incorporating those items, and

THAT the Hauraki District Council, in accordance with clause 20 (1) and (2) in Schedule 1 to the Resource Management Act 1991, publicly notifies that Items: 1, 3, 7, 8, 20, 25, 31, 32, 33, 39, 51, 61, 62, 64, 68, 73, 80, 94, 95, 96, 97, 99 and 107, as amended following the consideration of submissions, of Plan Change 4: Miscellaneous Plan Change will become ‘Operative’ from 15 September 2021.


Changes to the District Plan following consideration of submissions

Decisions Released 18 June 2021

At its meeting on 26 May 2021, the Hauraki District Council approved the decisions on submissions and further submissions on Proposed Plan Change 4 that were recommended by the District Plan Committee. The Committee (Proposed Plan Change 4) was appointed by the Council, and delegated authority pursuant to section 34(1) of the Resource Management Act 1991, to hear, consider and recommend decisions on submissions and further submissions.

The recommended decisions were made by the District Plan Committee following the closing of the hearing held on 18 and 22 April 2021. The Committee considered all submissions and further submissions, and heard evidence at the hearing.
