Council resolution on Electoral System and Right to Demand a Poll
Notice is given pursuant to Section 28 of the Local Electoral Act 2001 (the Act) that Hauraki District Council has resolved that the First Past the Post electoral system will be used for the 2025 triennial general election of the Hauraki District Council.
In accordance with Section 29 of the Act, electors of the Hauraki District Council have a right to demand a poll at any time to countermand the resolution to use the First Past the Post electoral system.
Should a valid demand for a poll be received by 11 December 2023, a poll will be held by 14 March 2024 on whether the First Past the Post electoral system or the Single Transferable Voting electoral system will be used for the next two triennial general elections (2025 and 2028) and any associated elections of the Hauraki District Council.
If a valid demand for a poll is received after 11 December 2023, a poll will be held after 14 March 2024 with the outcome applicable for the 2028 and 2031 triennial general elections (and any associated elections).
A valid demand must be:
- In writing
- Signed by at least 5% of the number of electors enrolled as eligible to vote at the previous (2022) triennial election of the Hauraki District Council. This will require at least seven hundred and sixty-six (766) eligible elector signatures
- The written demand must be addressed and delivered to the Principal Office of the Hauraki District Council, P O Box 17, or William Street, Paeroa
An elector may sign a demand and be treated as one (1) of the specified number of electors only if:
- the name of that elector appears on the electoral roll of the Hauraki District; or
- if the elector’s name does not appear on the Hauraki District roll, the name is included on the most recently published electoral roll for any electoral district under the Electoral Act 1993; or
- is currently the subject of a direction by the Chief Registrar under Section 115 of the Electoral Act 1993 which relates to unpublished names, and
- the address for which the elector is registered as a parliamentary elector is within the Hauraki District; or
- the address given by the elector who signed the demand is:
- confirmed by the Registrar of Electors as the address at which the elector is registered as a parliamentary elector; and
- within the Hauraki District; or
- the elector has enrolled, or has been nominated, as a ratepayer elector and is qualified to vote as a ratepayer elector in the elections of the Hauraki District Council.
Every elector who signs a demand must state against his or her name signature, the elector’s name; and the address for which the person is qualified as an elector of the Hauraki District.
