Proposed Plan Change 6: Extension of Martha Mineral Zone
(Clauses 5 and 21 of Schedule 1, Resource Management Act 1991)
Hauraki District Council has accepted a request for Proposed Plan Change 6 to the Operative Hauraki District Plan 2014 (Hauraki Section) from OceanaGold (New Zealand) Limited (OceanaGold) and is now calling for submissions under Schedule 1 to the Resource Management Act 1991 (RMA).
Proposed Plan Change 6 seeks to rezone 47 properties in Waihi, in the vicinity of the existing Martha Pit, to Martha Mineral Zone to enable future resource consent applications to be made for ‘surface mining’ associated with a proposed further cutback of the Pit. There are also some proposed changes to the existing provisions of the Martha Mineral Zone (Section 5.17 of the Hauraki District Plan) and to the Noise standards for that Zone (in Section 8.3.1 of the Plan).
The 47 properties proposed for rezoning are owned by, or under the control of OceanaGold, and include 15 properties currently located within the Town Centre Zone, 25 properties currently located within the Residential Zone and 7 properties currently located within the Low Density Residential Zone.
The Proposed Plan Change consists of the following document (with attachments):
Proposed Plan Change 6: Extension of Martha Mineral Zone which contains the proposed text and map changes to the District Plan.
The Proposed Plan Change may be inspected or purchased at the Hauraki District Council offices at 1 William Street, Paeroa; 84 Orchard West Road, Ngatea; 40 Rosemont Road, Waihi or any of the District libraries in Paeroa, Waihi or Ngatea, or online at www.hauraki-dc.govt.nz/plan-change-6/ (please contact Marina van Steenbergen 07 862 8609 if you have any questions about the proposal).
Any person may make a submission on the Proposed Plan Change but, if the person could gain an advantage in trade competition through the submission, then the person may do so only if the person is directly affected by an effect of the proposal that —
- adversely affects the environment; and
- does not relate to trade competition or the effects of trade competition.
The submission must be in accordance with Form 5 and must state whether or not you wish to be heard on your submission. Copies of this form are available from the Hauraki District Council offices, libraries and website.

Submissions close at 4.30pm on 28 March 2024.
The process for public participation in the consideration of the Proposed Plan Change under the Act is as follows:
- after the closing date for submissions, Hauraki District Council must prepare a summary of the submissions and decisions requested by submitters. This summary must be publicly notified;
- there must be an opportunity to make a further submission in support
of, or in opposition to, the submissions already made. The following
persons may make a further submission:
- any person representing a relevant aspect of the public interest;
- any person who has an interest in the Proposed Plan Change greater than the general public has; and
- Hauraki District Council.
- If a person making a submission asks to be heard in support of his or her submission, a hearing must be held;
- Hauraki District Council must give its decision on the Proposed Plan Change (including its reasons for accepting or rejecting submissions); and give public notice of its decision within 2 years of notifying the proposal and serve it on every person who made a submission at the same time; and
- any person who has made a submission has the right to appeal the
decision on the Proposed Plan Change to the Environment Court if,
- in relation to a provision or matter that is the subject of the appeal, the person referred to the provision or matter in the person’s submission on the proposal.
